Terms & Conditions

Please note that Tower Designs is based within the United Kingdom, hence, licence is a noun and license is a verb. In addition to this, the following terms are relevant to the applicable portions of code within a product, some products are based upon Open Source frameworks and as such we cannot apply our copyright or license terms to any code relating directly to that framework. Essentially, any code we have made is the licensed section; so style-sheets or custom functions or plug-ins (this is detailed in each licence).

'Individual' Licence Terms

  1. This licence grants you, the buyer, an ongoing, non-exclusive, international licence to make use of the digital product you have selected.
  2. You are licensed to use the product to create a single end product for yourself or a client, the end product can be distributed for free (so long as it is only to one recipient).
  3. The end product is:
    1. In the case of Templates or Themes, a customised implementation of the item.
    2. For other types, such as assets (e.g. graphics, images) the end product would incorporate the product and have a larger scope.
  4. You may create one end product, and transfer that single end product to your client for any fee.
  5. You may make any number of copies of the single end product, as long as the end product is distributed for free.
  6. You may modify or manipulate the item, you can combine the item with other works and make a derivative work from it. The results are subject to the terms of this licence.
  7. You cannot sell the end product, except to one client.
  8. You cannot re-distribute the item as stock, in a larger product, or bundled with other items.
  9. You cannot extract parts of the product to use as a single component in another end product or as standalone.
  10. You cannot and must not permit an end user of the end product to extract the item and use it separately from the end product.
  11. Bundled logos with templates or themes cannot be used in a logo, trademark, or service mark.
  12. Some items may be from third parties, and where applies will be labelled or described. That items licences will apply instead of this licence.
  13. Some items may be licensed under the GPU General Publice License (GPL) or other open source licences.
    1. Other items may be entirely created by myself, but are partially affected by the GPL, a 'split licence' applies. In effect the open source licence will affect these items but only to the extent of the GPL.
  14. You may only use the Item for lawful purposes. Also, if an Item contains an image of a person, even if the Item is model-released you cannot use it in a way that creates a fake identity, implies personal endorsement of a product by the person, or in a way that is defamatory, obscene or demeaning, or in connection with sensitive subjects.
  15. This licence can be terminated if you breach it. If that happens, you must stop making copies of or distributing the End Product until you remove the Item from it.
  16. The author of this Item retains ownership of the Item but grants you the licence on these terms.

'Volume' Licence Terms

  1. This licence grants you, the buyer (a company, business, individual, corporation, charity or organisation), an ongoing, non-exclusive, international licence to make use of the digital product you have selected.
  2. You are licensed to use the product to create multiple end products for your business or client(s), the end product can be distributed freely amongst your organisation's employees or staff in order to modify and develop the end product; furthermore it may be distributed to a client for free (so long as the end product has been customized for that client).
  3. The end product is:
    1. In the case of Templates or Themes, a customised implementation of the item.
    2. For other types, such as assets (e.g. graphics, images) the end product would incorporate the product and have a larger scope.
  4. You can create multiple end products, and transfer those individual end products to your client for any fee.
  5. You can modify or manipulate the item, you can combine the item with other works and make a derivative work from it. The results are subject to the terms of this licence.
  6. You cannot re-distribute the item as stock, in a larger product, or bundled with other items.
  7. You cannot extract parts of the product to use as a single component in another standalone end product (must be part of a greater work[1]).
  8. You cannot and must not permit an end user of the end product to extract the item and use it separately from the end product.
  9. Bundled logos with templates or themes cannot be used in a logo, trademark, or service mark.
  10. Some items may be from third parties, and where applies will be labelled or described. That items licences will apply instead of this licence.
  11. Some items may be licensed under the GPU General Public License (GPL) or other open source licences.
    1. Other items may be entirely created by myself, but are partially affected by the GPL, a 'split licence' applies. In effect the open source licence will affect these items but only to the extent of the GPL.
  13. This licence can be terminated if you breach it. If that happens, you must stop making copies of or distributing the end product until you remove the item from it.
  14. The author of this item retains ownership of the item but grants you the licence on these terms.

[1] For example, a button on a smartphone (mobile) or tablet template cannot be extracted and made into its own end product to be sold as-is, it must be part of another work - for example, as another smartphone (mobile) or tablet template.

Additional Information

I create commercial themes for open source (GNU GPL) frameworks, as such I cannot sell or licence the framework code, only what I create and apply 'on-top' of any frameworks. Below you will find listed the frameworks I develop for and their respective licensing:

Note: all products are packaged with a Licensing directory which will contain a copy of the above Licence agreements and a copy of the respective GPL; to determine which licence you own please consult your order history or contact us with a request for the licence agreement you bought. If you wish to upgrade from an 'Individual' licence to a 'Volume' licence please contact us and a discount can be arranged.

When arranging for a Volume licence it is recommended to fill in your Company name (this can be found in your Address Book entry). If you need help with this please get in touch.
